This distinction is vital and shall be strictly upheld in any disputes, regulatory reviews, or legal proceedings.

Users accept that all interactions happen at their own risk and discretion.

---

10. MODIFICATIONS

The Company may update these Terms at any time.

Continuing to use the Platform signifies acceptance of such changes.

11. PERFORMER STATUS AND LEGAL INDEPENDENCE (COMPREHENSIVE)

All individuals or entities providing content or services through Cameralux (collectively "Performers") operate as independent contractors. This relationship is fundamental to this Agreement and must be strictly interpreted in all legal, regulatory, and commercial matters.

Nothing in this Agreement or interactions between parties creates an employment, partnership, joint venture, fiduciary, or agency relationship between Cameralux and any Performer. Performers are not employees and are not entitled to employee benefits or protections under any jurisdiction.

Performers expressly accept and agree that they:

  • Control how, when, and what they perform;
  • Set their own working hours, frequency of appearances, and content style;
  • Use their own equipment and locations;
  • May work on other platforms or businesses, subject to their own contracts;
  • Bear all commercial risks related to their activities on the Platform.

The Company does not supervise or control any performance details. Platform tools are optional and do not imply control or oversight rights.

Where required by law, this clause preserves Performers’ independent contractor status to the fullest extent.

---

12. PERFORMER CATEGORIES (A / B / C STRUCTURE – FULL)

For clarity and responsibility allocation, Cameralux sorts Performers into these groups:

  • Category A – Independent Model: an individual operating on the Platform without intermediary management;
  • Category B – Studio: an organisation or individual managing one or more Models;
  • Category C – Studio Model: an individual working under a Studio’s supervision.

Each has distinct rights, duties, and liabilities. The Company may assign categories based on the nature of the relationship.

---

13. CATEGORY A – INDEPENDENT MODEL (FULL RESPONSIBILITY)

An Independent Model registers directly and manages their entire activity without Studio involvement.

The Independent Model must:

  • Create, upload, and manage all content;
  • Set prices, rates, and offerings;
  • Communicate with Members and handle interactions;
  • Ensure compliance with laws, including content, tax, and consumer regulations;
  • Keep required records such as proof of age and consent.

The Model represents and guarantees that:

  • They are at least 18 and have legal capacity to contract;
  • They participate voluntarily and without coercion;
  • They own rights to all uploaded or performed content;
  • They will not engage in prohibited conduct.

Financial and Tax Responsibilities:

The Independent Model is solely responsible for all taxes on earnings, including but not limited to:

  • Income tax reporting and payments;
  • VAT or equivalents where applicable;
  • Social or self-employment contributions;
  • Compliance with invoicing and record-keeping laws.

Examples by Jurisdiction (non-exhaustive):

  • UK: Models may be self-employed and must report earnings to HMRC;
  • EU: VAT may apply depending on thresholds and place of supply;
  • Brazil: Earnings may be taxed individually or via MEI or similar schemes;
  • USA: Models often treated as independent contractors for tax purposes.

The Company does not offer tax advice and disclaims responsibility for tax compliance.

---

14. CATEGORY B – STUDIO (MANAGEMENT AND LIABILITY)

A Studio is a legal person or individual managing one or more Models and is the principal party to Cameralux regarding those Models.

The Studio assumes full responsibility for:

  • Recruitment, onboarding, and management of Models;
  • Verifying identity and age of all Models;
  • Ensuring Models act voluntarily and lawfully;
  • Complying with labour, tax, and regulatory laws;
  • Maintaining legally required records, including consent and ID documentation.

The Studio guarantees that:

  • All Models under its control are at least 18;
  • No Model is coerced, exploited, or trafficked;
  • All consents are obtained and documented;
  • Operations comply with all relevant laws.

Liability:

The Studio is solely liable for acts or omissions of its Models. Cameralux holds no responsibility for:

  • Payments from Studio to Models;
  • Disputes between Studio and Models;
  • Studio’s employment law compliance.

Payment Flow:

  • Cameralux pays the Studio;
  • The Studio pays its Models;
  • Cameralux does not supervise internal distributions.

---

15. CATEGORY C – STUDIO MODEL (DERIVED RELATIONSHIP)

A Studio Model works under a Studio’s direction. They acknowledge that:

  • Their main contract is with the Studio, not Cameralux;
  • Cameralux is not their employer, agent, or guarantor;
  • All payment and contractual matters are handled with the Studio.

The Studio Model remains personally responsible for complying with Platform rules and laws.

---

16. CONTENT WARRANTIES AND CONSENT (STRICT REQUIREMENTS)

All Performers represent and warrant that:

  • All content is created with full, informed, voluntary consent of all involved;
  • No content features minors under any circumstances;
  • No content involves coercion, force, or exploitation;
  • All participants are legally capable of consenting;

Performers must keep verifiable consent records where required and provide these upon reasonable request by the Company or authorities.

Non-compliance will result in immediate termination and possible legal reporting.

---

17. INTELLECTUAL PROPERTY RIGHTS (EU-COMPLIANT)

Performers retain ownership of their content. By uploading or streaming, they grant Cameralux a license which is:

  • Non-exclusive;
  • Worldwide;
  • Royalty-free;
  • Transferable to service providers essential for Platform operation.

This license allows Cameralux to:

  • Host, store, and transmit content;
  • Display and stream to Members;
  • Use content for Platform promotion and operation.

This license is restricted to Platform operation and promotion and does not transfer ownership.

Moral rights are respected under EU law and cannot be waived where prohibited.

---

18. CONTENT MODERATION AND PLATFORM RIGHTS

Cameralux reserves the right, but not the obligation, to review, remove, restrict, or block content breaching this Agreement or laws.

Such actions may occur without notice when necessary to protect:

  • Users;
  • Platform integrity;
  • Legal compliance.

The Company does not conduct general monitoring beyond legal requirements.

---

19. PERFORMER EARNINGS AND PAYMENTS

Performers earn money through Member payments for services. Earnings depend on demand, pricing, and user activity.

Performers acknowledge that:

  • Earnings are not guaranteed;
  • Payments may vary in timing;
  • Third-party processors may affect payment delays.

Cameralux offers no minimum income guarantees.

---

20. FRAUD, ABUSE, AND PLATFORM PROTECTION

The Platform enforces strict anti-fraud rules. Prohibited activities include:

  • Artificially inflating traffic or earnings;
  • Using bots or automation;
  • Manipulating payment systems;
  • Collusion.

Violations may lead to suspension, termination, and financial recovery.

---

21. ACCOUNT SUSPENSION AND TERMINATION

Cameralux may suspend or close accounts where there is reasonable evidence of:

  • Agreement breaches;
  • Fraud or abuse;
  • Legal or regulatory risk.

Such actions may be taken without prior notice.

---

22. DATA PROTECTION FOR PERFORMERS

Performer data is handled in line with data protection laws.

Data may include:

  • Identity verification details;
  • Payment information;
  • Activity logs.

Data is processed for legitimate purposes and safeguarded appropriately.

---

23. LIMITATION OF LIABILITY (PERFORMER CONTEXT)

To the fullest legal extent, Cameralux is not liable for:

24. FINAL PERFORMER ACKNOWLEDGEMENT

By using the Platform, Performers confirm that:

  • They operate independently;
  • They accept full legal responsibility for their actions;
  • They understand the risks involved in digital platform activities.

This Agreement is the full understanding between Performer and Cameralux regarding Platform use.

25. PAYMENT FRAMEWORK AND DIGITAL CREDIT SYSTEM (COMPREHENSIVE)

Cameralux operates a closed-loop digital credit system that securely facilitates transactions between Members and Performers worldwide.

Members purchase digital credits through approved payment providers instead of buying content directly. These credits are then spent on services offered by Performers.

Credits are neither legal tender, electronic money, stored value, nor financial instruments. They represent a limited, non-transferable right to access digital services on the Platform.

Credits hold no value outside the Platform and cannot be redeemed for cash by Members under any circumstances.

The Company may change credit systems, pricing, or exchange rates at any time, provided existing purchased credits remain unaffected.

---

26. PAYMENT PROVIDERS AND REGULATORY STRUCTURE

Cameralux partners with multiple third-party payment providers to ensure global coverage and regulatory compliance.

These may include:

  • CCBill: global card processing, subscription management, adult industry compliance;
  • PayGarden: alternative payments like gift cards;
  • CoinPayments: cryptocurrency and blockchain payments;
  • PagSeguro and WePayments: Brazil-specific payment methods including PIX and local options.

Each provider operates independently under its regulatory framework, including:

  • Know Your Customer (KYC) procedures;

Members agree not to initiate chargebacks without contacting Cameralux support first.

Chargeback abuse includes:

  • Challenging valid transactions after use;
  • Repeated refund manipulation;
  • False claims of unauthorised payments.

Consequences include:

  • Account suspension or closure;

By implementing robust compliance measures, such as age verification, fraud detection, data protection, and payment security, Cameralux maintains trust, transparency, and integrity throughout its operations.
